Goobit takes MiCA rejection to court after second refusal in Sweden

Finansinspektionen refuses to reverse its rejection of Goobit AB's MiCA application. The dispute now moves to Förvaltningsrätten, where Goobit demands the decision be annulled and authorisation granted.

The decision concerns Goobit AB's request that Finansinspektionen itself amend the ruling of 2 July 2026, when the company's application for MiCA authorisation was rejected. The regulator finds no grounds to change the decision under Section 38 of the Swedish Administrative Procedure Act, which governs when an authority may reverse its own rulings. Förvaltningsrätten, the Swedish administrative court, has therefore not examined Goobit's objections or the substance of the case.

Regulator says its handling followed the rules

Finansinspektionen concludes in today's decision that its handling of the case complied with applicable rules and that there are no grounds to amend the rejection of 2 July. Goobit AB is the group company that operates the crypto exchange BTCX and that applied for authorisation under the MiCA framework in the EU/EEA.

Ander sees today's decision as a procedural step

"It is of course a disappointment that Finansinspektionen has chosen not to change its decision. At the same time, today's message is a procedural step and not a court examination of the questions we have raised."

The case moves on to Förvaltningsrätten

Goobit is pursuing its appeal and takes the case to Förvaltningsrätten, demanding that the decision be annulled and that the company be granted authorisation. In the alternative, it asks for the matter to be referred back to Finansinspektionen for a full and renewed review.

"We maintain that Goobit's application should be assessed on the basis of our actual operations, our limited range of services and the control environment the company has built and continues to strengthen. After many years in the Swedish bitcoin industry, I feel a great responsibility for these questions to be properly and objectively examined."

Neither outcome nor timeline is settled

The company says nothing can be stated with certainty about how the court process will end or how long it will take.

"We are therefore continuing the process in a constructive and responsible manner. At the same time, we are transparent about the fact that neither the outcome nor the timetable for the court process can be assessed with certainty." Christian Ander, chief executive of Goobit Group AB

It is now Förvaltningsrätten that decides whether the rejection stands.
